**Déclaration de protection des données Coop Finance+**

**1	 Quelle est la finalité de la présente déclaration de protection de données?**

Nous attachons une grande importance à la protection des données et traitons les vôtres avec le plus grand soin, conformément aux dispositions légales en vigueur. Une protection des données efficace va de pair avec une information transparente. La présente déclaration de protection des données vous informe donc sur le traitement de vos données et sur la finalité de ce traitement. 

La présente déclaration de protection des données s'applique aux prestations de Coop Finance+ (ci-après "prestation"). Elle précise essentiellement:

•	qui est responsable du traitement des données personnelles;
•	quelles sont les données que nous traitons et d'où elles proviennent; 
•	à quelles fins nous les traitons;
•	à qui nous les transmettons.

La <a href=" https://www.coop.ch/fr/entreprise/protection-des-donnees.html" target="_blank">déclaration générale de protection des données du groupe Coop</a> s'applique additionnellement. Vous y trouverez notamment les informations suivantes: 

•	la définition des notions générales (point 6); 
•	un complément d'information sur les fins auxquelles les données sont traitées (point 8);
•	la base légale sur laquelle nous nous reposons pour traiter vos données (point 9);
•	la durée pendant laquelle nous conservons vos données (point 15);
•	la manière dont nous protégeons vos données (point 16);
•	vos droits et comment vous pouvez les faire valoir (point 5);
•	des informations concernant la page Internet et les cookies (point 18).

**2	 À qui incombe la responsabilité du traitement des données personnelles?**

La responsabilité du traitement des données selon la présente déclaration incombe à Coop Société Coopérative, Thiersteinerallee 12, 4053 Bâle (ci-après "nous"). 

Dans le cadre de l'utilisation de la présente prestation, il se peut que vous concluiez un contrat directement avec l'une de nos entreprises partenaires du domaine financier et de la prévoyance (ci-après "partenaires") pour des prestations bancaires, prestations de prévoyance et autres prestations financières. Nos partenaires du domaine financier et de la prévoyance incluent actuellement la Banque Hypothécaire de Lenzbourg SA, la Banque Cantonale de Glaris ainsi que Liberty 3a Fondation de prévoyance et Liberty Fondation de libre passage. Le traitement des données dans le cadre de l'exécution du contrat par les partenaires relève de la responsabilité de ces derniers. Les dispositions en matière de protection des données qui s'appliquent sont les leurs.

Coop peut à tout moment proposer de nouveaux services et produits fournis par d'autres partenaires. Ces derniers sont alors responsables du traitement des données correspondant.

**4	 Quelles données personnelles traitons-nous et d'où proviennent-elles?**

Pour fournir la prestation selon la présente déclaration de protection des données, nous traitons les données suivantes:

•	données de base (notamment civilité, nom, prénom, sexe, date de naissance, adresse, adresse mail, téléphone, nationalité, état civil, langue, rapports de travail, affiliation à une caisse de pension, numéro de client, numéro de Supercard);
•	données contractuelles (données nécessaires à l'exécution de la prestation, y compris d'éventuels retours et réclamations);
•	données financières (p. ex. données concernant la fortune et les revenus, la solvabilité, la provenance et la légitimité des avoirs);
•	données de communication (en particulier: nom et données de contact, contenu de la correspondance et données secondaires);
•	données de transaction et de comportement (p. ex. informations relatives aux chiffres d'affaires reçues quotidiennement de nos partenaires – voir plus loin – ou données collectées dans le cadre du programme Supercard pour l'attribution des superpoints);
•	données relatives à vos préférences (pour nous aider à améliorer nos produits et services - voir aussi point 5) en reliant, par exemple, des données de transaction et de comportement à d'autres données; 
•	données d'identification en ligne (p. ex. cookies, adresses IP, fichiers log);
•	données de trafic et de suivi en ligne (p. ex. comportement de navigation, clics à la réception de newsletters);

En général, ces données nous sont communiquées directement par vous. En cas de demande de carte supplémentaire, c'est la ou le titulaire du compte qui nous communique ces données. Dans certains cas, nous les relevons nous-mêmes soit en passant pas vous soit automatiquement, p. ex. lorsque vous utilisez nos services, faites des achats chez nous, surfez sur nos sites ou utilisez nos applis. Il s'agit dans ces cas-là notamment des données relatives aux transactions et aux comportements, des données d'identification en ligne, des données de trafic et de suivi en ligne. Parfois aussi, nous obtenons des données à partir d'informations préexistantes, par exemple en analysant les données relatives à vos transactions ou à vos comportements.

Les données nous provenant directement des partenaires sont les suivantes:

•	confirmation d'enregistrement (notamment l'IBAN et le numéro de contrat);
•	données d'identité (copie du passeport/de la carte d'identité ou d'autres enregistrements permettant l'identification);Nous n'utilisons ces données qu'aux fins mentionnées au point 5.

Les autres données que nous recevons de nos partenaires peuvent être des données en rapport avec le profil de risque, des données relatives au logement, des données de contact et des données contractuelles, des données en rapport avec le produit (p. ex. produit utilisé avec données de transaction, historique du compte, performance).

Nous pouvons aussi faire appel au service de mise à jour des adresses auprès de prestataires tiers ou d'autres sociétés du groupe pour obtenir votre adresse actuelle.
Dans certaines circonstances, nous pouvons également recevoir d'autres données de la part de tiers. Les dispositions de la déclaration générale de protection des données du groupe Coop s'appliquent alors (point 7).

**5	 À quelles fins traitons-nous vos données personnelles?** 

Nous traitons vos données personnelles à des fins:

•	d'exécution d'un contrat;
•	de communication;
•	de marketing et information;
•	d'études de marché et sondages d'opinion; 
•	d'exercice de droits juridiques; 
•	de respect d'exigences légales; 
•	de sécurité;
•	autres (p. ex. processus internes et tâches administratives).

Vous trouverez de plus amples informations à ce sujet dans la déclaration générale de protection des données du groupe Coop. Comme il y est indiqué, nous pouvons également procéder à des évaluations et créer des profils à des fins de marketing ou pour personnaliser les contenus. Pour la présente prestation, nous n'utilisons pas de données supplémentaires provenant d'autres sociétés ou formats du groupe Coop.

Nous ne traitons les données mentionnées au point 4 en provenance des partenaires qu'aux fins suivantes:

•	confirmation d'enregistrement: conclusion et exécution du contrat; synchronisation et correction d'erreurs; utilisation à des fins de marketing en rapport avec la présente prestation.
•	comme données contractuelles: pour la synchronisation et la correction d'erreurs.
•	comme données d'identification: pour la conclusion et l'exécution du contrat.
Le traitement des données du site web et de l'appli s'effectue conformément au point Informations sur les sites web et les cookies de la déclaration générale de protection des données du groupe Coop.

**6	 À qui transmettons-nous vos données personnelles?**

Nous pouvons transmettre vos données personnelles comme suit:

•	Partenaires: les données personnelles nécessaires à l'exécution du contrat par le partenaire doivent être transmises à ce dernier. C'est le partenaire qui procède à leur traitement sous sa propre responsabilité. Il n'utilise pas vos données à des fins de marketing propres, sauf si vous avez établi une relation contractuelle avec lui sous une autre forme ou si vous y avez consenti. Vous trouverez la liste de nos partenaires au point 2.
•	Au sein du groupe Coop: nous pouvons transmettre des données au sein du groupe Coop à des fins administratives. Les autres sociétés du groupe Coop ou formats de Coop Société Coopérative n'effectuent aucun traitement des données en relation avec la présente prestation à des fins propres, notamment de marketing, ou pour des activités de marketing. 
•	Tiers: dans le cadre de l'exécution de la présente prestation, nous pouvons faire appel à des prestataires tiers, qui peuvent, dans certaines circonstances, traiter les données à l'étranger. Vous trouverez plus d'informations à ce sujet dans la déclaration générale de protection des données du groupe Coop (points 10.2 et 11).
 
**7	 Modification de la présente déclaration de protection des données** 

Nous nous réservons le droit d'apporter des modifications à la présente déclaration de protection des données, par exemple si les modalités de traitement ou la situation juridique évoluent. Les modifications seront publiées sur les sites web correspondants. Nous vous informerons séparément, pour autant que cela n'entraîne pas un volume de travail disproportionné.

e solo secondo le disposizioni di legge applicabili. Per proteggere adeguatamente i dati 
è fondamentale un’informazione trasparente. Per questo, con la presente dichiarazione sulla protezione dei dati, la informiamo sulle modalità e le finalità di trattamento dei suoi dati. 

La presente dichiarazione sulla protezione dei dati vale per i servizi di Coop Finance+ (di seguito «servizio»). Nella presente dichiarazione sulla protezione dei dati la informiamo in particolare in merito ai seguenti punti:

•	chi è responsabile del trattamento dei dati;
•	quali dati trattiamo e da dove provengono; 
•	per quali scopi avviene il trattamento dei dati;
•	a chi inoltriamo i dati.

**2	 Chi è responsabile del trattamento dei dati personali?**

Per il trattamento dei dati in conformità alla presente dichiarazione sulla protezione dei dati è responsabile Coop Società Cooperativa, Thiersteinerallee 12, 4053 Basilea (di seguito «noi»). 

Nell'ambito dell'utilizzo della presente prestazione, per i servizi bancari, previdenziali e altri servizi finanziari stipulerà eventualmente un contratto direttamente con uno dei nostri partner dei settori finanziario e previdenziale (di seguito «partner»). I nostri partner dei settori finanziario e previdenziale includono al momento la Banca Ipotecaria di Lenzburg SA, la Banca cantonale di Glarona, Liberty 3a Fondazione di previdenza e Liberty Fondazione di libero passaggio. Il trattamento dei dati nell'ambito dell'adempimento del contratto da parte dei partner è di competenza di questi ultimi e si applicano le loro disposizioni in materia di protezione dei dati.

Coop può proporre in qualsiasi momento nuovi servizi e prodotti di ulteriori partner. In tal caso, i partner selezionati saranno a loro volta responsabili del relativo trattamento dei dati..

**4	 Quali dati trattiamo e da dove provengono?**

Per fornire il servizio in conformità con la presente dichiarazione sulla protezione dei dati trattiamo i seguenti dati:

•	dati di base (in particolare appellativo, cognome, nome, sesso, data di nascita, indirizzo, indirizzo e-mail, numero di telefono, cittadinanza, stato civile, lingua, rapporto d’impiego, affiliazione a casse pensioni, numero di cliente, numero Supercard);
•	dati contrattuali (tutti i i dati necessari alla prestazione del servizio incl. eventuali feedback e reclami);
•	dati finanziari (p.es. dati patrimoniali e reddituali, dati sulla solvibilità, dati relativi alla provenienza di valori patrimoniali o al diritto a essi);
•	dati di comunicazione (in particolare nome e dati di contatto, contenuti della corrispondenza e dati marginali della comunicazione);
•	Dati comportamentali e relativi alle transazioni (p.es. le informazioni giornaliere sul fatturato che otteniamo dai nostri partner, cfr. sotto; oppure i dati rilevati nell'ambito del programma Supercard per l'assegnazione dei punti Supercard):
•	dati relativi a preferenze (per adattare meglioi nostri prodotti e servizi alle sue necessità possiamo trattare dati relativi alle sue preferenze (cfr. anche il punto 5). A tale proposito possiamo p.es. collegare dati relativi a comportamenti e transazioni con altri dati.); 
•	identificatori online (p.es. identificatori di cookie, indirizzi IP, file log);
•	dati sul traffico e sul tracciamento online (p.es. navigazione sul sito web o nell’app, click al ricevimento delle newsletter);

Di norma riceviamo tali informazioni direttamente da lei. In caso di richiesta di una carta supplementare, riceviamo i relativi dati dalla/dal titolare del conto. In alcuni casi, inoltre, raccogliamo dati sul suo conto in modo autonomo o automatico, p.es. quando utilizza il servizio, naviga sui nostri siti web o utilizza l’app. in particolare, dati comportamentali e relativi alle transazioni, dati di identificatori online, dati di tracking e di traffico online. In determinati casi possiamo anche ricavare i dati da dati esistenti, per esempio valutando i dati relativi alle transazioni o al comportamento.

I seguenti dati ci giungono direttamente dai partner:

•	conferma di onboarding (tra cui rientrano in particolare il codice IBAN e il numero di contratto);
•	dati identificativi (copia del passaporto / della carta d’identità oppure ulteriori registrazioni per l’identificazione);Trattiamo tali dati solo agli scopi indicati al punto 5.

Altri dati che otteniamo dai nostri partner includono dati relativi al profilo di rischio, dati sulla situazione abitativa, dati di contatto e di contratto, dati relativi al prodotto (p.es. prodotto utilizzato incl. dati sulle transazioni, account history, performance ecc.). 

Per poter disporre del suo indirizzo attuale possiamo avvalerci di servizi di aggiornamento di indirizzi offerti da prestatari terzi o da altre società del gruppo.

Possiamo eventualmente ricevere anche ulteriori dati da terzi. A tale proposito si applicano le disposizioni contenute nella dichiarazione generale sulla protezione dei dati del Gruppo Coop (punto 7).

**5	 A quale scopo trattiamo i suoi dati personali?**

Trattiamo i suoi dati personali ai seguenti scopi:
•	esecuzione di contratti;
•	comunicazione;
•	marketing e informazioni;
•	ricerche di mercato e di opinione; 
•	rivendicazione di diritti legali; 
•	conformità ai requisiti legali; 
•	sicurezza;
•	ulteriori scopi (p.es. procedure interne e amministrazione).

Informazioni dettagliate sui vari scopi si trovano nella dichiarazione generale sulla protezione dei dati del Gruppo Coop. Come indicato, abbiamo anche la facoltà di procedere a valutazioni e di creare profili a scopo di marketing e per personalizzare i contenuti. A tal fine, per la presente prestazione non ci avvaliamo di dati supplementari provenienti da altre società o formati del Gruppo Coop.

Trattiamo i dati che riceviamo dai partner in base al punto 4 solo per i seguenti scopi:

•	conferma di onboarding: adempimento del contratto incl. stipula ed esecuzione del contratto; sincronizzazione e correzione di errori; scopi di marketing in relazione al presente servizio.
•	Dati contrattuali: sincronizzazione e correzione di errori.
•	Dati identificativi: adempimento del contratto incl. stipula ed esecuzione del contratto.

Per l’elaborazione dei dati del sito web e dell’app si applicano le informazioni relative al sito web e ai cookie della dichiarazione generale sulla protezione dei dati del Gruppo Coop.

**6	 A chi trasmettiamo i dati personali?** 

Abbiamo la facoltà di trasmettere i suoi dati personali come segue:

•	Partner: i dati personali necessari per l'adempimento del contratto da parte di un partner devono essergli trasmessi. In tal caso, il partner tratta tali dati sotto la propria responsabilità. Il partner non utilizza i dati a propri fini di marketing, a meno che lei non abbia con lui un rapporto contrattuale in altra forma o lo abbia autorizzato in tal senso. I partner si trovano al punto 2.
•	All’interno del Gruppo Coop: abbiamo la facoltà di trasmettere dati all’interno del Gruppo Coop a fini amministrativi. Altre società del Gruppo Coop o altri formati di Coop Società Cooperativa non trattano a fini propri i dati in relazione al presente servizio, in particolare non a scopo di marketing o per attività di marketing. 
•	Terzi: nell’ambito della prestazione del servizio abbiamo la facoltà di ricorrere a prestatari terzi, i quali possono eventualmente trattare i dati anche all’estero. Troverà maggiori informazioni a tale proposito nella dichiarazione generale sulla protezione dei dati del Gruppo Coop (punti 10.2 e 11).

**7	 Modifiche della presente dichiarazione sulla protezione dei dati**

Abbiamo la facoltà di modificare nel tempo la presente dichiarazione sulla protezione dei dati, per esempio in caso di emendamenti o di cambiamenti della situazione legale. Le modifiche saranno pubblicate sui relativi siti web. Se possibile con un onere proporzionato, riceverete una comunicazione separata.

Diese Datenschutzerklärung gilt für Coop Finance+ Dienstleistungen (nachfolgend «Dienstleistung»). 

In der vorliegenden Datenschutzerklärung informieren wir Sie insbesondere über folgende Punkte: 

• wer für die Datenbearbeitung verantwortlich ist; 
• welche Daten wir bearbeiten und von wo diese stammen; 
• zu welchen Zwecken die Bearbeitung erfolgt; 
• an wen wir die Daten weitergeben.

**2 Wer ist für die Bearbeitung von Personendaten verantwortlich?**

Für die Datenbearbeitung nach dieser Datenschutzerklärung ist die Coop Genossenschaft, Thiersteinerallee 12, 4053 Basel, verantwortlich (nachfolgend «wir»). 

Im Zusammenhang mit der Inanspruchnahme der vorliegenden Dienstleistung schliessen Sie unter Umständen für Bank-, Vorsorge- und andere Finanzdienstleistungen direkt einen Vertrag mit einem unserer Partnerunternehmen im Finanz- und Vorsorgebereich (nachfolgend «Partner») ab. Zu unseren Partnern im Finanz- und Vorsorgebereich zählen derzeit die Hypothekarbank Lenzburg AG, die Glarner Kantonalbank sowie die Liberty 3a Vorsorgestiftung und die Liberty Freizügigkeitsstiftung. Für die Datenbearbeitung im Rahmen der Vertragserfüllung durch die Partner sind diese verantwortlich und es gelten deren Datenschutzbestimmungen. 

Coop kann jederzeit neue Dienstleistungen und Produkte von weiteren Partnern anbieten. 

In diesem Fall sind wiederum die gewählten Partner für die entsprechende Datenbearbeitung verantwortlich.

**4 Welche Daten bearbeiten wir und woher stammen diese?**

Für die Erbringung der Dienstleistung nach dieser Datenschutzerklärung bearbeiten wir folgende Daten: 

• Stammdaten (insbesondere Anrede, Name, Vorname, Geschlecht, Geburtsdatum, Adresse, E-Mailadresse, Telefonnummer, Staatsangehörigkeit, Zivilstand, Sprache, Beschäftigungsverhältnis, Pensionskassenanschluss, Kundennummer, Supercard-Nummer); 
• Vertragsdaten (sämtliche Daten die für die Erbringung der Dienstleistung notwendig sind inkl. allfäl-lige Rückmeldungen und Beschwerden); 
• Finanzdaten (z.B. Daten zu Vermögens- und Einkommensverhältnisse, Angaben zur Bonität, Angaben über die Herkunft von und Berechtigung an Vermögenswerten); 
• Kommunikationsdaten (insbesondere Name und Kontaktangaben, Inhalt der Korrespondenz und Randdaten der Kommunikation); 
• Verhaltens- und Transaktionsdaten (z.B. die täglichen Umsatzinformationen, die wir von unseren Partnern erhalten, vgl. unten; oder Daten, welche im Rahmen des Supercard-Programms für die Zuweisung der Supercard-Punkte erhoben werden); 
• Präferenzdaten (Um unsere Produkte und Dienstleistungen besser auf Sie anzupassen, können wir Daten zu Ihren Präferenzen bearbeiten (vgl. auch Ziff. 5). Hierzu können wir bspw. Verhaltens- und Transaktionsdaten mit anderen Daten verknüpfen.); 
• Onlinekennungen (z. B. Cookie-Kennung, IP-Adressen, Log-files);
• Online-Tracking- und Verkehrsdaten (z. B. Surfverhalten der Webseite oder App, Klick-Verhalten beim Erhalt von Newslettern); 

Wir erhalten diese Daten im Normalfall direkt von Ihnen. Im Fall einer Zusatzkartenbeantragung erhalten wir diese Daten durch die Kontoinhaber:innen. In gewissen Fällen erheben wir Daten über Sie auch selbst oder automatisch, z. B. wenn Sie die Dienstleistung nutzen, auf unserer Webseite surfen oder in der App aktiv sind. Darunter fallen insbesondere Verhaltens- und Transaktionsdaten, Onlinekennungen, Online-Tracking- und Verkehrsdaten. In bestimmten Fällen können wir die Daten auch aus bestehenden Daten ableiten, indem wir z. B. die Transaktions- oder Verhaltensdaten auswerten. 

Die nachfolgenden Daten erhalten wir direkt von den Partnern: 

• Onboardingbestätigung (darunter fällt insbesondere die IBAN und Vertragsnummer); 
• Identifikationsdaten (Kopie des Reisepasses/ID oder weitere Aufzeichnungen zur Identifikation); Diese Daten bearbeiten wir nur zu den in Ziff. 5 genannten Zwecken. 

Weitere Daten, die wir von unseren Partnern erhalten, umfassen Daten im Zusammenhang mit dem Risikoprofil, Daten zur Wohnsituation, Kontakt- und Vertragsdaten, Daten im Zusammenhang mit dem Produkt (z.B. verwendetes Produkt inkl. Transaktionsdaten, Account History, Performance). 

Damit wir jeweils eine aktuelle Adresse von Ihnen haben, können wir Adressaktualisierungsservice von Drittdienstleistern oder von anderen Gruppengesellschaften beziehen und erhalten so jeweils Ihre aktuelle Adresse. 

Unter Umständen können wir auch weitere Daten von Dritten erhalten. Hierfür gelten die Bestimmung in der allgemeinen Datenschutzerklärung der Coop-Gruppe (Ziff. 7).

**5 Zu welchem Zweck bearbeiten wir Ihre Personendaten?**

Wir bearbeiten Ihre Personendaten zu den folgenden Zwecken: 

• Vertragserfüllung; 
• Kommunikation; 
• Marketing und Informationen; 
• Markt- und Meinungsforschung; 
• Geltendmachung rechtlicher Ansprüche; 
• Einhaltung rechtlicher Anforderungen; 
• Sicherheit; 
• weitere Zwecke (z.B. interne Abläufe und Administration).

Einzelheiten zu den verschiedenen Zwecken finden Sie in der allgemeinen Datenschutzerklärung der Coop-Gruppe. 

Wie dort aufgeführt können wir zu Marketingzwecken und um Inhalte zu personalisieren auch Auswertungen vornehmen und Profile bilden. Hierfür verwenden wir für die vorliegende Dienstleistung keine zusätzlichen Daten von anderen Gesellschaften oder Formaten der Coop-Gruppe. 

Die Daten, welche wir gemäss Ziff. 4 von den Partnern erhalten, bearbeiten wir nur zu den nachfolgenden Zwecken: 

• Onboardingbestätigung: Vertragserfüllung inkl. Abschluss und Abwicklung des Vertrags; Synchronisierung und Fehlerkorrekturen; Marketingzwecke im Zusammenhang mit der vorliegenden Dienstleistung. 
• Vertragsdaten: Synchronisierung und Fehlerkorrekturen. 
• Identifikationsdaten: Vertragserfüllung inkl. Abschluss und Abwicklung des Vertrags. Für die Datenbearbeitung der Webseite und der App gelten die Webseite und Cookie-Informationen der allgemeinen Datenschutzerklärung der Coop-Gruppe.

**6 An wen geben wir Ihre Personendaten weiter? **

Wir können Ihre Personendaten wie folgt weitergeben: 

• Partner: Personendaten, welche für die Vertragserfüllung durch den Partner notwendig sind, müssen an diesen weitergegeben werden. Der Partner bearbeitet in diesem Fall die entsprechenden Daten in eigener Verantwortung. Der Partner verwendet Ihre Daten nicht für eigene Marketingzwecke, aus-ser Sie haben in anderer Form eine Vertragsbeziehung mit dem Partner oder Ihre Einwilligung dafür erteilt. Sie finden unsere Partner unter Ziff. 2. 
• Innerhalb der Coop-Gruppe: Wir können Daten innerhalb der Coop-Gruppe zu Administrationszwecken weitergeben. Andere Gesellschaften der Coop Gruppe oder Formate der Coop Genossenschaft bearbeiten Daten im Zusammenhang mit der vorliegenden Dienstleistung nicht zu eigenen Zwecken, insbesondere nicht für Marketingzwecke oder für Marketingaktivitäten. 
• Dritte: Im Rahmen der Dienstleistungserbringung können wir Drittdienstleister beiziehen. Solche Drittdienstleister können unter Umständen auch im Ausland Daten bearbeiten. Mehr Informationen hierzu finden Sie in der allgemeinen Datenschutzerklärung der Coop-Gruppe (Ziff. 10.2 und 11).

**7 Änderungen dieser Datenschutzerklärung**

**Coop Finance+ Privacy Policy**

**1	 What is the purpose of this Privacy Policy and what does it tell you?**

Data privacy is a priority for us, and we always process your data with the utmost care and in accordance with the applicable statutory requirements. Transparent information is essential for effective data privacy. In this Privacy Policy, we tell you how and for what purposes we process your personal data. 

This Privacy Policy applies to Coop Finance+ services (hereinafter "Service"). In this Privacy Policy we inform you about the following points in particular:

• who is responsible for processing the data;
• which data we process and where they are obtained; 
• the purposes for which they are processed; 
• who we share the data with.

The <a href="https://www.coop.ch/en/company/privacy-policy.html" target="_blank">Coop Group Privacy Policy</a> also applies. It contains the following additional information in particular: 

• general definitions of terms (see Clause 6); 
• additional information regarding the purposes for which we process data (see Clause 8);

**2	 Who is responsible for processing personal data?**

The he Coop Cooperative, Thiersteinerallee 12, 4053 Basel (hereinafter “we”) is responsible for data processing in accordance with this Privacy Policy. 

When using the present Service, you may conclude a contract for banking services, pension services or other financial services directly with one of our partner companies in the financial and pensions sector (hereinafter “Partners”). Our Partners in the financial and pensions sector currently include Hypothekarbank Lenzburg AG, Glarner Kantonalbank, the Liberty Foundation for 3a Retirement Savings and the Liberty Foundation for Vested Pension Benefits. The Partners are responsible for data processing in the context of performing their contracts, and their own data protection provisions apply.

Coop may offer new services and products from other Partners at any time. In this case, the selected Partners are again responsible for the relevant data processing.

**4	 Which data do we process and where are they obtained?**

In order to provide the Service in accordance with this Privacy Policy, we process the following data:

•	Person master data (in particular title, last name, first name, gender, date of birth, address, e-mail address, telephone number, nationality, marital status, language, employment relationship, pension fund membership, customer number, Supercard number);
•	Contractual data (all the data needed in order to provide the Service including any feedback and complaints);
•	Financial data (e.g. data about assets and income, information about creditworthiness, information about the origins of and entitlement to assets);
•	Communication data (in particular name and contact details, content of correspondence and metadata relating to the communication);
•	Behavioural and transactional data (e.g. the daily turnover data we receive from our Partners – see below; or data gathered in relation to the Supercard programme so that Supercard points can be allocated);
•	Preference data (In order to customize our products and services to suit you better, we may process data regarding your preferences – see also Clause 5. In order to do this we may, for example, combine behavioural and transactional data with other data); 
•	Online identification data (e.g. cookie identifier, IP addresses, log files);
•	Online tracking and traffic data (e.g. browsing behaviour on the website or app, clicking behaviour when receiving newsletters);
We usually obtain this data directly from you. If an additional card is applied for, we will receive these details from the account holder. In certain instances, we also collect data about you ourselves or automatically, e.g. when you use the Service, browse our website or use the app. Such data include, in particular, behavioural and transactional data, online identification data, and online tracking and traffic data. In certain instances we may also derive the data from existing data, for example by analysing transactional or behavioural data.
We receive the following data directly from our Partners::
•	Onboarding confirmation (including in particular the IBAN and contract number);
•	Identification data (copy of passport/ID or other identification records);

We process these data only for the purposes specified in Clause 5.
Other data we receive from our Partners include data connected with the risk profile, housing situation, contact and contract details, or information relating to the product (e.g. product used, including transaction data, account history, performance).
To ensure that we always have your current address, we may utilize an address update service provided by third parties or other group companies in order to find out your present address.

In some circumstances we may also receive other data from third parties. The provisions of the Coop Group Privacy Policy apply in this case (Clause 7).

**5	For what purpose do we process your personal data?**

We process your personal data for the following purposes:
•	contract performance;
•	communication;
•	marketing and information;
•	market and opinion research; 
•	asserting legal claims; 
•	complying with legal requirements; 
•	security;
•	other purposes (e.g. internal procedures and administration).

Details of the different purposes may be found in the Coop Group Privacy Policy. As described therein, we may also perform analyses and build profiles for marketing purposes and in order to personalize content. When doing so in connection with the present Service, we do not use any additional data from other companies or formats of the Coop Group.

The data we receive from our Partners in accordance with Clause 4 are processed by us for the following purposes only:

•	Onboarding confirmation: Contract performance including conclusion and execution of the contract; synchronization and rectification of errors; marketing purposes in connection with the present Service.
•	Contractual data: Synchronization and rectification of errors.
•	Identification data: Contract performance including conclusion and execution of the contract.
For data processing in relation to the website and the app, the website and cookie information in the Coop Group Privacy Policy applies.

**6	To whom do we pass on your personal data?** 

We may pass on your personal data as follows:

•	Partners: Personal data required by the Partners for the performance of the contract will need to be passed on to them. In this case, the Partner processes the relevant data on its own responsibility. The Partner does not use your data for its own marketing purposes unless you have entered into another form of contractual relationship with the Partner or given your consent. A list of our Partners may be found in Clause 2.
•	Within the Coop Group: We may pass on data within the Coop Group for administrative purposes. Other Coop Group companies or Coop Cooperative formats do not process data relating to the present Service for their own purposes, and specifically not for marketing purposes or marketing activities. 
•	Third parties: We may call on third-party service providers in connection with the provision of this Service. These third-party providers may also process data abroad. More information on this topic may be found in the Coop Group Privacy Policy (see Clauses 10.2 and 11).

**7	Changes to this Privacy Policy** 

We may amend this Privacy Policy from time to time, e.g. if the types of processing or the legal situation change. Changes will be published on the relevant websites. You will be notified separately of such changes insofar as this is reasonably practicable.

Terms of use of the "Coop Finance+" app

1. Scope/General

The Coop Cooperative, Thiersteinerallee 12, 4053 Basel (hereinafter "Coop") operates the "Coop Finance+" mobile application (hereinafter "the App"). The purpose of the App is to enable users to conclude agreements with selected partners (hereinafter "Partners") in the area of pensions, insurance and other financial services (hereinafter "Financial Sector").

The present terms of use (hereinafter "Terms of Use") govern the use of the App.

By using the App you expressly declare your consent to these Terms of Use.

In using the App, you may conclude an agreement directly with selected Partners (see Services offered, in section 3 below). With regard to the services provided by the Partners, the terms that apply are exclusively the respective Partner’s terms and conditions, including any General Terms and Conditions, which may be viewed using this App.

2. Terminology

The term "Coop Finance+" describes the Financial Sector services made available via the App. It does not refer to a legal person.

3. Services offered by the Partners

Through the App, Coop makes available to you a platform for concluding agreements with selected Partners in the Financial Sector.

Coop is not a supplier of Financial Sector services and does not provide any financial services. In relation to insurance companies, Coop counts as a tied insurance broker within the meaning of the Insurance Oversight Act (IOA). 

The information contained in the App in no way constitutes an offer or recommendation to purchase or sell financial instruments or to enter into agreements regarding financial services or other services (e.g. opening a bank account) by Coop or an invitation to do so. Coop is not in 
any way subject to licensing, registration or other obligations under financial market supervision law, apart from the obligations arising from Coop’s activity as a tied insurance broker.

Similarly, the retrieval of information about the customer in order to create a user account is in no way a form of recommendation, advice or other financial service.

The decision whether to conclude an agreement with a Partner for a related service is your responsibility.

Information contained in this App regarding services in the Financial Sector labelled with the name of one of our Partners originates from the respective Partner and not from Coop. The Partner concerned is responsible for this information.

You acknowledge that the respective Partners are solely responsible for complying with the legal and contractual provisions applicable to the offer to purchase and to the provision of services in the Financial Sector

4. Target audience and restrictions on use
he use of the App and and the conclusion of agreements with Partners in the financial sector (hereinafter “Use of the App”) are reserved exclusively for natural persons resident in Switzerland. 

Persons deemed to be US persons are also excluded from the Use of the App. The term “US persons” covers: 

(i) natural persons resident in the United States; 

(ii.) United States nationals;

(iii) US persons within the meaning of the US Foreign Account Tax Compliance Act (FATCA); 

(iv) companies, trusts and businesses organized or incorporated under the laws of the United States; 

(v) agencies and branches of non-US companies located in the United States; 

(vi) discretionary asset management accounts or similar accounts (other than an estate or trust) held by a dealer or other fiduciary organized or incorporated in the United States or, in the case of a natural person, resident in the United States; 

(vii) estates of which any executor or administrator is a US person;

(viii) trusts of which any trustee is a US person;

(viv) partnerships of which one or more partners is a US person. 

Also excluded from the Use of the App are natural and legal persons who

(i) are subject to a sanction imposed by Switzerland, the European Union, the United Kingdom or the United States, or who 

(ii) have direct or indirect beneficial ownership of a legal person subject to such a sanction, or who 

(iii) are organised or resident in a jurisdiction, country or region subject to a nationwide or region-wide sanction imposed by Switzerland, the European Union, the United Kingdom or the United States. The Use of the App is intended purely for private purposes. By downloading, installing and/or using the App, you confirm that you fulfil these requirements at all times.

5. Use of the App

5.1 No unlawful use

You undertake always to use the App in a lawful manner. In particular, you may not:

- use the App for illegal purposes or in any manner incompatible with these Terms of Use, or act fraudulently or maliciously, such as through hacking or by inserting malicious codes (including viruses or harmful data) into the App;
- use the App in a manner that could in any way damage, deactivate, overload, endanger or harm our systems or their security, or could hinder or endanger other users; 
-collect or capture information or data about the App or our systems, or attempt to decrypt transmissions to or from the systems that operate the App; or
- use the App to transmit defamatory, racist, discriminatory, illegal, unethical or otherwise inappropriate information;
- copy or alter the App or decompile the App's code, except as provided for by law.
- use the App to transfer funds of which you are not the beneficial owner.

5.2 Technical requirements

Technical access to the App is gained via your terminal device. You choose the supplier of the access service (e.g. internet provider or telecommunications service provider). The term "terminal device" refers both to the hardware used for access (including mobile equipment such as smartphones) and to the operating software. Your terminal device must always meet the latest security requirements (see also Your duty of care, in section 5.5 below). 

5.3 Registration

Registration for the App is exclusively reserved for competent persons (i.e. those who are of age and able to make judgements) whose competence is not restricted by an official adult protection measure. Registration is not open to competent persons for whom a representative deputyship has been established which prevents them from accessing their assets. 

Upon first using the App, you will be requested to create a user account and store the necessary customer details. The details required on registration must be entered truthfully and completely. For security reasons, the mobile phone number and e-mail address may be checked by means of a confirmation request. You are responsible for updating your own details.

If an additional card is applied for, the account holder will be prompted to enter the required customer details for the person for whom the additional card is being requested. The account holder must ensure that the required details are entered correctly and in full. For security 4 of 9 reasons, the mobile phone number and e-mail address may be verified by sending a confirmation request to the person for whom the additional card is being requested. 
Subsequently, the person for whom the additional card is being requested is responsible for keeping their data up to date.

Registration is free. There is no entitlement to being approved to use the App.

5.4 Authentication

Access to the App is granted via two-factor authentication to anyone who can prove their authorization by entering the registered e-mail address, the password and the second authentication feature, such as a text message or Face ID ("Means of Authentication"). 

You acknowledge unreservedly that all instructions and communications sent to Coop using the valid Means of Authentication are deemed to have been sent and authorized by you. With regard to the Partners, you acknowledge unreservedly that all instructions, communications and orders sent to the Partners using the valid Means of Authentication are deemed to have been sent and authorized by you. 

5.5 Your duty of care

Regarding Means of Authentication

You are required to change your selected password regularly. The password should not consist of an easily identifiable combination (such as a telephone number, date of birth or car registration number). 

You must keep your password and your other Means of Authentication secret and protect them from misuse by unauthorized persons. In particular, your password must not be stored in an unprotected manner. Your Means of Authentication must not be passed on or otherwise made accessible to third parties. You must not respond to requests apparently originating from Coop asking you to disclose your password (e.g. requests by e-mail or e-mails with links to login pages, known as phishing e-mails).

You must log off from the App each time you finish using it.

If you suspect that unauthorized third parties have discovered your password, you must change this password immediately. If this is not possible, you must call the Service Center immediately (see section 7 below) and ask it to block access to the relevant services.

Regarding terminal device

When you use the internet or mobile services, there is a constant danger that third parties may obtain access to your personal data undetected and that viruses may spread to your terminal device while you are using the App. Using up-to-date antivirus programs can reduce the risk and you are recommended to use these. In order to minimize the risk of unauthorized access to your terminal device, you must also take the customary security precautions. We recommend 5 of 9 you set up a password for accessing your terminal device and avoid using public Wi-Fi networks. 

You are required to keep the operating system of your terminal device up to date, install all the recommended software and security updates immediately, and always use the latest version of the App. 

If you suspect that unauthorized persons have gained access to your terminal device, you must report this to the Service Center (see section 7 below) immediately. 

5.6 Breaches of duty of care

You acknowledge that you bear the loss caused by improper use of your Means of Authentication. 

5.7 Consequences of failure to comply with the Terms of Use

We can at any time terminate your right to use the App if you have breached these Terms of Use. 

If we terminate your right to use the App, you must permanently delete the App from all devices in your possession and we are entitled to deny you access to the services via the App.

6. Availability of the App

6.1. Availability of services and information on the App

Coop takes all reasonable steps to enable you to access the App, apart from during regular and irregular maintenance periods, and thus to access the information it contains and the related services. However, Coop cannot guarantee access to the App at all times. Access to the App 
may temporarily or for an extended period be disrupted or rendered impossible owing to technical problems that are your responsibility or the responsibility of a network operator, power company or Coop itself.

Investment transactions, whereby the amounts paid in are automatically invested in accordance with the selected investment strategy, or sold off in the case of withdrawals, are executed every two weeks. Strategy changes, whereby changes of strategy instigated by you as the end customer are implemented, are executed once a week. If the App cannot be accessed due to technical problems shortly before an investment transaction and/or strategy change, the 
investment transaction and/or strategy change will automatically be postponed until the following week. 

Coop also reserves the right to suspend access to the App, and thus to the information it contains and the related services, in special circumstances (particularly in the event of security risks or maintenance work).Coop may alter certain functions of the App (temporarily or permanently), such that you may not always be able to access all services. In addition there is a 6 of 9 possibility that you may not be able to use the App (at all, or only for certain functions) owing to the operating system or model of your terminal device.

You have no claim whatsoever against Coop for any such malfunction or interruption. 

6.2. Amendments to the App

We reserve the right to update the App automatically from time to time in order to improve performance, increase functionality, take account of changes to the operating system or rectify security issues. Alternatively, we may ask you to update the App for these reasons. 

If you decide not to install such updates, or you decide against automatic updates, you may no longer be able to use the App and the related services.

7. Support

For technical questions regarding the use of the App, please contact the Service Center during normal office hours on +41 (0)848 116 611 (CHF 0.08/min.). Alternatively, we advise you to consult the FAQs on our website at www.coopfinanceplus.ch.

8. Push notifications

Coop has introduced a push notification service for notices connected with the App (hereinafter "Push Notifications"), which forms part of the App. When Push Notifications are activated on your terminal device, you will receive various types of information in the form of a message sent directly to your terminal device, such as notifications relating to services provided by the Partners. 

You yourself must activate Push Notifications on your terminal device. Activation and deactivation are carried out directly via your end device’s operating system.

Coop offers no guarantee that Push Notifications will function correctly, and in particular it guarantees neither the receipt nor the transmission speed of Push Notifications. Coop accepts no responsibility in the event that Push Notifications are not sent or received. 

You understand and acknowledge that Push Notifications and their content are still visible when the App is not open or is running in the background, and possibly also when your terminal device is locked. In consequence, you understand and accept that third parties who have access to your terminal device may also obtain access to the content of the Push Notifications. 

We advise you against using the App on another person’s mobile device or activating Push Notifications on such a device.

9. Rights to the App

You are permitted to use the App in compliance with these Terms of Use. Your right of use is restricted to private use and is not exclusive, not transferable and may be revoked by us at any time. Any other use, particularly the duplication, modification, copying, sharing and sale of the App, is prohibited. The use of the services provided by the Partners in the App does not count as use of the App. 

With the exception of the right of use conferred above, all rights (including all intellectual property rights) in the App accrue to Coop and/or third parties engaged by Coop ("Owners"). The Owners’ rights to the App remain explicitly reserved. 

10. Third-party content

The App also contains content (e.g. General Terms and Condition) from the Partners. You acknowledge that Coop has not verified such content and is not responsible for it. In this respect, please note also the limitation of liability (see section 12).

11. Outsourcing

In order to outsource all or part of the activities, Coop is entitled to obtain services from third parties in Switzerland and abroad. Subject to the exclusion of liability (see section 12), these outsourced activities remain under the responsibility and supervision of Coop. In relation to data protection, Clause 6 of the Coop Finance+ Privacy Policy applies to outsourcing (see also section 13 below, Data protection).

12. Restriction of liability and restriction of warranty

In connection with the use of the App, Coop is liable solely for damage caused to you by Coop or its employees intentionally or through gross negligence. You acknowledge that any further liability on the part of Coop is excluded. 

You acknowledge that Coop has no obligations in relation to the services provided by the Partners and that the Partners alone are responsible for them. Coop therefore accepts no liability for the services made available via the App Furthermore, Coop accepts no liability for the content of websites connected to the App by links, or for content, documents and other information provided by the Partners that can be connected to or accessed from the 
App. 

You are responsible for technical access to the App, and especially for the network providers and for the hardware and software you use. You acknowledge in particular that Coop accepts no responsibility for the network providers and excludes any liability for damage caused to you through transmission errors, technical faults, malfunctions, illegal infiltration of telecommunications systems and networks, network congestion, deliberate blocking of electronic access by third parties, interruptions or other transmission failures.

Although we endeavour to ensure that the App is up to date and free of programming errors, we cannot guarantee this. 

Coop provides no guarantee regarding the operating mode and availability of the App or access to the services. You release Coop from any liability that could arise from the use of the App, or from the inability to use the App or access the services. 

13. Data protection

The Coop Finance+ Privacy Policy governs our use of your personal details. We expressly refer to this Privacy Policy. The Coop Finance+ Privacy Policy may be viewed here

14. Final provisions

14.1 Amendments to the Terms of Use

Coop reserves the right to amend these Terms of Use at any time. Coop will in each case communicate the amended Terms of Use to you in an appropriate manner four weeks in advance. In each case, the amendments come into force as soon as they are implemented. 

You hereby agree to be bound by the amended Terms of Use as soon as you first use the App after the changes have been implemented

14.2 Relationship to additional provisions

Specific areas of the App may contain additional provisions, conditions, information, instructions etc. (hereinafter "Additional Provisions"). In the event of any discrepancies between the present Terms of Use and the Additional Provisions relating to the use of the App, the present Terms of Use take precedence. 

For the avoidance of misunderstandings, it should be noted that the legal relationship between you and the Partners is governed not by these Terms of Use but solely by the General Terms and Conditions and other contractual provisions of the Partners.

14.3 Separability clause

Should parts or individual provisions of these Terms of Use prove unenforceable or invalid and/or contradict the legal requirements, this shall not affect the validity or enforceability of the remaining provisions. In place of the invalid or unenforceable provision, a valid and enforceable provision shall be applied which reflects as closely as possible the commercial purpose that you and Coop intended to pursue by means of the invalid, unenforceable provision.

14.4 Applicable law and place of jurisdiction

The legal relationship between you and Coop in relation to the use of the App is governed by substantive Swiss law to the exclusion of conflict of law provisions. 

The place of jurisdiction for disputes between you and Coop in connection with the use of the App is your domicile or Basel-Stadt.
